What to do if you receive a summons and complaint:

A constable may approach you to serve you with a Summons and Complaint, which means that a suit has been filed with the court. Accept the document and contact your insurance company immediately. The failure to take prompt action may result in a default judgment.

If you are insured by the Lifespan Malpractice Plan, contact Lifespan Risk Services (LRS). A claims adjuster and an attorney will be assigned to the case. You will be contacted promptly.

Do not attempt to call the attorney who is bringing the action against you, nor any of the parties in the case.Don't discuss the case with anyone other than the claims adjuster and attorney assigned to you by LRS. Others with whom you have discussions may be deposed regarding those conversations.
